PCT national phase in PolandThe following information and documents are required to file Polish patent application in PCT national phase:
Notes: Information indicated with (*) is obligatory. Additional information and/or documents may be provided later upon the PPO request (usually within 3-4 weeks after filing). The deadline to enter the national phase amounts 30 months from priority date. In urgent cases, to preserve the above deadline, it is sufficient to file only the abstract of the specification, as well as the filing particulars. Remaining parts of the filing documentation must be sent to the PPO within 3 months from the filing date. PCT international phase in PolandFirst filing is a procedure to apply for a patent protection for an invention that has not been previously disclosed. In general the procedure comprises the following steps: 1. initial consultations - to preliminary assess if the invention is new, industrially applicable and has a so called inventive step, as well as the complexity of the invention (for this purpose we recommend to send us the filled form of Preliminary Specification of Invention); 2. prior art search - to determine the set of similar inventions already known to the public; 3. drafting the specification - to define the highest possible scope of protection of the invention (patent claims), which simultaneously should guarantee that the patent shall be granted (this step is performed with close co-operation with the inventor(s)); 4. repeating the steps a) to c); 5. actual filing of the international PCT application at the Polish Patent Office; Click here to download the For further proceedings see the PCT application timeline below.
