European patents in Poland

Any European patent that was filed after March 01, 2004 may be protected in Poland, providing the applicant applied for its validation within 3 months after the mention of the grant publication.

Bear in mind that according to the Polish Industrial Property act, the scope of protection of validated European patent is determined on the basis of the Polish translation of the patent specification and claims, not their original version. Hence, the incorrect translation may greatly impair the protection of the invention in Poland.

Filing requirements

In order to complete the validation formalities we shall need the following particulars:

• the European patent number,
• the Power of Attorney form duly signed by a person(s) entitled to represent the applicant.

The PoA form may be provided later, upon the PPO request (usually within 3-4 months after filing).

Preliminary protection of European applications in Poland

Prior the European patent is granted the applicant may also apply for the temporary protection of the invention covered by the European patent application.

Demand for temporary protection in Poland should enclose the Polish translation of patent claims and needs to be filed between the European publication and the decision to grant a European patent.

In order to file the demand we shall need the following particulars:

• the European publication number,
• the Power of Attorney form duly signed by a person(s) entitled to represent the applicant.

The PoA form may be provided later, upon the PPO request (usually within 3-4 months after filing).
