European Community Designs

Success of design or your product's shape causes that its apperance may become synonym of brand or your company's image and influence its value.

An industrial design is an appearance of the whole or a part of a product which is:

  • new,
  • results from the features of the product, and
  • has an individual character.

The features of the product embrace, in particular, the lines, colours, shape, texture or materials of the product and its ornamentation.

You should file your industrial design application as soon as you can, before someone else does it. Nevertheless, in case of European Community Design, you have one year period when you can offer your design in the marketplace without destroying its novelty.

One application provides protection of your affairs in every country which is a member of the European Union.

A right in registration of Community Design:

  • gives you exclusive rights to use design in trade;
  • acts as prevention of infringements;
  • may be obtained quickly and without many formalities;
  • is legally valid in every country of the EU;
  • gives you the right to forbid unauthorised use of your design in every country of the EU, and stop import your design to the EU.



Keep your design in secret before you are ready to file the application. Registered community design is usually published by the European office OHIM right after the filing. The publication may be postponed by 30 months. Thanks to that, your projects may be kept in secret until you are ready to disclose them.
